Estimadas familias,
Desde la Junta en funciones de la PTA Richard Ford queremos informaros de una serie de cuestiones que consideramos de suma importancia.
Como ya sabéis por nuestros Estatutos (están a vuestra disposición colgados en el blog y se adjuntan a este correo) el período de mandato de la Junta Directiva de la PTA es por dos años, lo que significa que no tendríamos que renovar, por votación en asamblea, la composición de la Junta Directiva hasta el inicio del curso 2013-2014 , sin embargo, debido a una serie de acontecimientos que se han producido y dadas las circunstancias, los actuales miembros de la Junta (en funciones), nos vemos en la necesidad de convocar elecciones para la designación en Asamblea General de socios de la nueva Junta Directiva de nuestra Asociación.
Nuestros estatutos son muy ambiguos y no detallan el proceso a seguir para la renovación de la Junta Directiva. Dado que la situación actual de nuestra PTA requiere de una solución inmediata ya que por causas ajenas a nosotros nos hemos demorado bastante en el tiempo y de una u otra forma había que adoptar una fórmula válida de llevar a cabo el procedimiento, debido a que es la primera vez que se produce esta situación en nuestra Asociación, después de informarnos sobre el procedimiento que se sigue en otras AMPA de colegios de toda España y tras contar con asesoramiento legal sobre este tema; hemos llegado a la conclusión que el procedimiento mediante la presentación de CANDIDATURAS CONJUNTAS es el más idóneo por considerarse totalmente transparente, democrático y que contribuye al buen funcionamiento de la Junta Directiva como equipo de trabajo.
Las candidaturas conjuntas son las formadas por un grupo de socios/as que se unen para presentarse como grupo, eligiendo cada uno de los socios integrantes un puesto dentro de la Junta Directiva. La Asociación de Padres y Madres de Alumnos deberá tener cubiertos, al menos, los siguientes puestos de forma obligatoria: Presidente/a, Secretario/a y Tesorero/a; además, podrán existir tantos puesto de vocales como se estime oportuno, sin límite ni por exceso ni por defecto. Por lo tanto, las candidaturas conjuntas deberán estar formadas por, al menos, tres miembros. Nuestros estatutos no obligan a que se tenga en cuenta la figura del Vicepresidente para la composición del comité ejecutivo de la Junta Directiva, pero nuestra experiencia aconseja que sí se tenga en cuenta dado que “al Vicepresidente le corresponden las mismas atribuciones que al Presidente, siempre que lo sustituya, bien por delegación, ausencia, enfermedad o vacante” (art. 23).
Todos aquellos socios y/o socias de la PTA que estéis interesados en presentar candidatura cerrada para formar parte de la Junta Directiva de la Asociación, podéis hacerlo rellenando el impreso al efecto (archivador adjunto al buzón de sugerencias de la PTA situado en hall de entrada) o imprimirlo desde el blog (ptastgeorgesevilla.blogspot.com) desde el mismo día de la recepción de esta información por email y hasta el día 3 de diciembre de 2012, inclusive. Este impreso debéis entregarlo POR DUPLICADO (se os hará llegar una copia) en el buzón de la PTA, en un sobre CERRADO junto con una fotografía reciente de cada candidato, con el nombre y apellidos escritos por detrás. Una vez finalizado el plazo de presentación de candidaturas, el día 3 de diciembre de 2012 a las 16.30 h, éstas (si se han hecho correctamente conforme a lo mencionado) se expondrán públicamente en el tablón de anuncios de la PTA, se publicarán en el blog y se enviarán a los socios a través de los emails de los que dispone la PTA, con el fin de publicitar al máximo las candidaturas entre los socios/as.
SOLO PODRÁN PRESENTAR CANDIDATURA Y VOTAR AQUELLOS MIEMBROS SOCIOS DE LA ASOCIACIÓN QUE LO SEAN ANTES DE LA FINALIZACIÓN DEL PERIODO DE PRESENTACIÓN DE CANDIDATURAS. Es decir, actualmente sólo se consideran socios a aquellos que se hicieron y abonaron su cuota a lo largo del curso lectivo 2011-2012. Si alguien que no lo es en la actualidad quiere participar en las votaciones en la próxima asamblea o presentar candidatura, debe hacerse socio antes del día 3 de diciembre de 2012. Para ello deberá rellenar el impreso correspondiente (en archivador junto al buzón de sugerencias de la PTA) o imprimirlo desde el blog (ptastgeorgesevilla.blogspot.com) y junto con el justificante de ingreso de la cuota (50 euros, por familia y año) en el nº de CC de la PTA 2100 1442 0001 0071 2361 de La Caixa introducirlos en un sobre cerrado en el buzón de la PTA (sin el justificante de ingreso no se considerará socio/a). No olvidéis especificar al hacer el ingreso el concepto de “Cuota PTA familia apellidos”.
Se convocará a II Asamblea general ordinaria y extraordinaria el próximo día 4 de diciembre de 2012, para proceder, entre otros temas, a la presentación de las candidaturas y a la elección. Los candidatos a formar parte de la Junta Directiva, tendrán en esta asamblea un tiempo para presentarse a los socios asistentes, y explicar su proyecto. La votación será nominal y por escrito rellenando la papeleta de voto que se facilitará al inicio de la asamblea (para la adopción en la asamblea de los restantes acuerdos diferentes al de elección de la Junta el voto se hará a mano alzada). De la elección que se haga en esta asamblea saldrá la Junta Directiva de la PTA Richard Ford del St.George’s School of Seville para los próximos dos cursos, es decir 2012-2013 y 2013-2014.
Sólo será válido un voto por familia (padre, madre o tutor legal).
Según está recogido en nuestros Estatutos:
“Para el cómputo de socios o número de votos total, las representaciones o delegaciones efectuadas por los socios se presentarán a la persona titular de la Secretaría al inicio de la sesión. El socio que no asista la Asamblea General podrá delegar su voto haciéndose representar por el socio que hubiere designado, en escrito dirigido a la Junta Directiva. También podrá delegarse en la votación para Presidente, Vicepresidente, Secretario, Vicesecretario y Tesorero” (art.12).
“La representación o delegación de voto sólo será válida para la sesión o convocatoria por la que se expida, siendo nula cualquier delegación o representación indefinida. La representación o delegación de voto constará por escrito, con indicación de los datos personales, número en la asociación de la persona delegante y representada y firmado y rubricado por ambas” (art.14).
El socio/a que vote en representación de otro/a lo especificará en la papeleta de voto en el apartado correspondiente.
El recuento de los votos se hará en la propia asamblea.
RESUMEN PROCESO ELECCIÓN JUNTA DIRECTIVA 2012-2014 PTA RICHARD FORD
- Desde la recepción de este email hasta el 3 de diciembre de 2012 a las 16.30 h: Presentación de candidaturas conjuntas.
- Día 3 y 4 de diciembre de 2012: publicación de las candidaturas conjuntas en el tablón de anuncios de la PTA, en el blog y a través de los emails de los que disponga la PTA.
- Día 4 de diciembre de 2012: Elección de Junta Directiva PTA RICHARD FORD en Asamblea General Ordinaria- Extraordinaria de socios/as.
Además de la elección de la nueva Junta Directiva se van a tratar otros temas, entre ellos el de la modificación de nuestros Estatutos con el fin de solventar los problemas que pueden ocurrir por la ambigüedad con que en ellos se tratan algunos aspectos de suma importancia para el desarrollo del AMPA con normalidad. Por este motivo la asamblea a la que os convocamos para el próximo 4 de diciembre tiene carácter de ordinaria y extraordinaria al mismo tiempo. La actual Junta en funciones ha hecho una serie de propuestas de modificación que os enviamos junto con este email. Las modificaciones con respecto a los actuales estatutos (también se os envían y están colgados en el blog de la PTA) aparecen en negrita.
Rogamos que toda la documentación que se os adjunta sea leída con anterioridad a la asamblea para no consumir tiempo de la misma.
La asistencia a la asamblea será libre, es más, animamos a todos los padres, madres y/o tutores a que asistan, si bien debemos aclarar que sólo los socios podrán emitir votos para la elección de la Junta y para cuantos otros temas así lo requieran.

Dear Families,
The acting Board of PTA Richard Ford wants to inform you about a series of questions that we consider very important.
As you know by our Statutes the period for the Board of the PTA is two years, which means that we would not have to renew the composition of the Board until the start of the course 2013-2014. However, due to a series of events and circumstances, the present members of the Board (acting) are in the need of holding elections for the General Assembly designation of members of the new Board of our PTA.
Our Statutes are very vague and do not detail the process for the renewal of the Board. Since the current status of our PTA requires an immediate solution because through no fault of us have quite delayed in time and in one way or another had to take a valid formula to perform the procedure, and because it is the first time this situation occurs in our Association, after being informed about the procedure followed in other PTAs throughout Spain and after having legal advice on this issue, we concluded that the proceeding by filing of joint bids is considered the most suitable for fully transparent, democratic and contributing to the smooth functioning of the Board and staff.
Joint bids are those formed by a group of members coming together to stand as a group, choosing each of them a position within the Board. The PTA must have covered at least the following compulsory positions: President, Secretary and Treasurer; in addition, there may be many vocal positions as deemed fit, without limitation by excess or defect. Therefore, the joint candidates should be formed by at least three members. Our Statute do not require that you consider the figure of Vice President for the composition of the executive committee of the board, but in our experience it is encouraged to consider themselves as "The Vice President will have the same duties as the President when he stands in for him, which will happen by delegation, absence, illness or vacancy. "(art. 23).
All those members of the PTA who are interested in submitting closed candidacy to join the Board of the Association can just fill in the form to this effect (file attached to the PTA suggestion box, located in the lobby of the school) or print it from the blog (ptastgeorgesevilla.blogspot.com) from the day of receiving this information by email and to December 3th, 2012. This form must be delivered duplicated in the PTA suggestion box in a sealed envelope along with a recent photograph of each candidate, with the full name written on the back. On the deadline for applications, on December 3th, 2012 at 16:30 h, these (if made correctly according to the above) will be displayed publicly on the bulletin board of the PTA, will be published in the blog and sent to members through emails, in order to publish them among members.
ONLY THOSE WHO ARE MEMBERS OF THE ASSOCIATION BEFORE THE DAY OF THE ASSEMBLY CAN BE CANDIDATES AND/OR VOTE. That is, members currently only considered are those who were and paid their fee over the course 2011-2012. If someone who is not currently a member wants to participate in the vote at the next meeting or submit bid, must first become a member before December 3th, 2012. To do this, he/she should complete the appropriate form (in the file by the PTA suggestion box) or print it from the blog (ptastgeorgesevilla.blogspot.com) and together with the proof of payment of the fee (50 euros per family per year) at No. PTA CC 2100 1442 0001 0071 2361 of La Caixa place it in a sealed envelope in the PTA suggestion box (no proof of income means not a member). Do not forget to specify the concept of "Cuota PTA familia surnames".
The meeting at December 4th, 2012 is an Ordinary and Extraordinary General Assembly to proceed, among other things, the submission of nominations and the election. Candidates to join the Board at this meeting will have the time to introduce the members and explain their project. The vote shall be in writing form, filling out the ballot to be provided at the beginning of the assembly (adoption of the agreements other than the election of the Board shall be voted by show of hands). The choice made in this assembly will become the PTA Richard Ford of St.George 's School of Seville Board for the next two courses, ie 2012-2013 and 2013-2014.
It is only one vote per family (parent or guardian).
As is enshrined in our Statutes:
“Article XXII: All agreements will be reached by majority vote. Any member who does not attend an Assembly can delegate his vote to another Member, as long as he expresses it in writing to the Board of Directors. This is also valid for the elections for President, Vice President, Secretary and Treasurer”.
The person to vote on behalf of another member must specify it in the corresponding section on the ballot.
The recount will be done in the assembly.
ELECTION PROCESS SUMMARY 2012-2014 PTA RICHARD FORD BOARD
- Upon receipt of this email until December 3th, 2012: Application of joint candidacies.
- December 3th and 4th, 2012: publication of joint bids in the bulletin board of the PTA, on the blog and through emails to members.
- December 4th, 2012: Election of PTA RICHARD FORD Board in Ordinary/Extraordinary Assembly.
In addition to the election of the new Board, other issues will be addressed, including the amendment of our Statutes in order to solve the problems that may occur from the ambiguity with which some very important aspects are treated. For this reason the assembly to which we invite you to in December 4th is Ordinary and Extraordinary at the same time. The current acting Board has made a number of proposals for amendments which are sent with this email. Changes compared to existing statutes (also sent, and posted on the blog of the PTA) are in bold.
We ask you to read all documentation attached prior to the meeting.
Attendance at the meeting will be free, and we indeed encourage all parents and / or guardians to attend, although we must clarify that only members may cast votes for the election of the Board and other issues that may require voting.
